DA slams state's invasion of private health care

Zille argues that NHI will deepen failiures of pubilic sector


I refer to the Saturday Star Article by Xolani Mbanjwa 20th June 2009


Its amazing that a heated debate has to take place in Parliament of the failing health system and the high cost of private health care and the ever increasing costs of medical aids and their continuing reduction of benefits.


It should be understood by all that while the previous ANC government was making its mind up about antivirals and ego's were flying left right and back, lives were being lost in the hundreds of thousands. The patients bill of rights if it is ]going to be worth the paper it is written on should include the sick to,(and be honoured) and include not only right wing politicians, who listened to crack pot sweet foreign talking so called specialists with questionable back grounds. but include all opinions.


The Industry requires total transparency. And a good start would be to give a tax benefit to

the employed for payments to the health scheme against claims/benefits.

There is no doubt that the state hospitals lack funding or adequate ability to fiscally manage their resources relative to the staff patient load. Outsourcing the states facilities might be an option.


A similar method of handling day to day emergencies is to use private hospitals. Claims can be managed as they are done similar to workman compensation. The national health will only apply to South African citizens. Management of collection of National heath can be done on a similar model to a the medical aid infrastructure in South Africa.

ARE ESKOM PRICE HIKE'S INHUMAN?













If Electricity is costing more lets find out ? why, Rather then telling the public that we have been having it cheap for to long by people who were not even born when the old infrastructures were set up. Electricity is a right not a luxury. Is South Africa going Backwards or forwards. Will every South African now use candles made by Sasol. Eskom if you cant do the job ship out there are plenty other private energy generation concerns that will do your jobs for less. Instead of pay increases and bonuses, why not a drop in pay, get rid of your bloated infrastructure. Your move to increase prices are inflationay and have caused Jobs to be lost, people to have lost their homes Ask Mr Zwelinzima Joseph VAVI and COSATU AND ITS Members what they Think of your price hikes ?, Do you and the staff that got millions of rands in Bonuses sleep good at night when, other South Africans are left out of the cold Mr Thulani Gcabashe.

If you are unable to do the job, recuse yourself from the position or we will demand changes. We demand a tender for change. Stop the madness before you spend more money on useless expensive power generation don’t talk green go green. We need an Accountant to run ESKOM with vision not a Bachelor of arts academic who did a course in finance for non finance managers who ran a failed money eating technology that the Europeans threw out years ago called a pebble bed reactor PBMR (Stop experimenting with our money.Well done Eskom they just put another engineer in charge when will they ever learn Mr Jacob Maroga, Well of course this guy is going to spend he’s an engineer the previous was a Bachelor of Arts Student. Sure you could have these guys on the board but not running the ship,
You need a man with a tight fist that will turn over the cents before they are spent. You have a recipe for disaster here don’t you guys ever learn. I need to catch my breath here!! I just can believe who is so incompetent to see the folly here, I mean I don’t want be personal these are great people, but you don’t run a successful company into the ground like this in 15 years, and let the consumers take the blame, how dare you !!

The Road Accident Fund in South Africa




In South Africa historically drivers and passengers involved in Motor vehicle accidents were protected by a 3rd party system of insurance. A minimal amount was paid to any one of the counties insurers usually the one that handled your comprehensive cover on your vehicle.

Claims were managed by attorneys who specialised in these sorts of matters, they were usually protracted litigious matters and took around 2 years to settle.
Post Apartheid saw the advent Road Accident Fund and the dissolution of the 3rd party system. Funding of the system and payout would come from a tax/levy taken from petrol at sales point.
There has been abuse by unscupulous attorneys putting through false claims per press.
There has been uneeded expenditure in protracted in litiguation against claimants by raf .
The management of the fund is questionable and should be audited by independant Auditors.
The public who is funding the RAF is not happy with the management or the ACT for the following:

By Statute the Government has taken away the citizen common law rights to seek compensation from other parties.

Compensation at state health institutions is preposterous given the state of the South Africa's State institutions.

I belive that changes of this nature should not be done by parliment, it must be by referendum.


On the 29th September 2008, basically about 2 months after the amendment to the act, I was a passenger in a motor accident and have been left with a damaged left hand that is palsy. I
have been out of action for 8 months. Cant do the things I used to and do drive at the moment.

In the aforgoing the new act is explained with a brief history

On the 1 August 2008 the Road Accident Fund Amendment Act was implemented. It brought about some major changes in how the fund operates. We will first review what the Road Accident Fund is all about and then we will take a more in-depth look at the changes and how it affects all of us. Any accidents that took place before the 1 August 2008 still fall under the old rules.
What is the Road Accident Fund?
The fund is controlled by government and was formed after the approval of legislation to cover drivers and passengers for any bodily injuries, or death, sustained as a result of a road accident caused by a negligent driver. The negligent driver is not allowed to claim from the fund, only the third parties. The fund falls under the jurisdiction of the Department of Transport. Money to sustain the fund comes from a levy included in the price of fuel so every motorist in South Africa contributes to the fund every time you fill your car with petrol. Contributions to the Road Accident Fund are also referred to as Third Party Insurance but is should not be confused with Third Party Insurance cover that you will take out to protect yourself against personal claims by third parties, or to pay for the damage to the property of third parties.
How does the Fund operate?
A third party, or his dependants, can implement a claim against the fund for injuries sustained, or for death, that resulted from the negligence of a driver. What happens is that the Road Accident Fund takes over the responsibility of the negligent driver.
What and how much can be claimed?
The new act removed certain inequalities to ensure that all innocent road users will be able to claim for injuries, medical treatment and loss of income. Before the amendments came into effect there was no limit to the amount that could be claimed as loss of income, now a maximum limit of R160 000 per year applies for income loss or loss of support, irrespective of the number of dependants. The Road Accident Fund stipulates that the driving of a car must have led to the injuries or death; if a car falls on a mechanic while he is working on it, he cannot claim from the Road Accident Fund.
The right to sue the guilty party
Another very important change, that goes hand in hand with the one above, is that a claimant no longer has the right to sue the guilty party in the event of an accident. This will restrict the claimant’s potential to sue for full compensation. As an example, if you have earned more than R160 000 a year and are totally disabled after the accident, you can only claim the maximum of R160 000. The implication is that you should ensure that you have sufficient income protection insurance, medical aid and disability cover to make up for the shortfall, if you fall in this category.
Medical Costs
Medical cost claims will now be limited to the rates charged by public health authorities so if you are treated in a private hospital the difference will have to be covered by your medical aid or by yourself.
Passenger Limitation and General Damages
Previously passengers was limited to a maximum claim of R25 000, this limitation has been removed and passenger claims will be settled in full, subject to the maximum limits applicable. General Damages will compensate claimants for pain and suffering and disfigurement. However, take note of the fact that the Road Accident Fund’s liability for general damages will be limited to “serious” injuries as determined by certain laid-down rules and by a medical practitioner. Previously one could claim for things such as “loss of pleasure,” this will probably not be classed as a serious injury under the new rules.
Property Damage
As has always been the case, no claims for any damage to property can be made to the RAF. You can still claim for the damage to your car from the guilty party or his insurance company.
A common law right
The amendment act has removed a person’s common law right to sue the guilty party for injuries or death. This is a very emotional issue and it is probably only a matter of time before we see this being tested in the constitutional court.
What should you do?
If you are concerned about the new limits that apply, as you fall into a higher income bracket, the best advice is to consult your insurance broker and review your total insurance portfolio to ensure that you and your family are adequately protected in case of death or serious injury. Previously some claimants could claim unlimited compensation from the fund while others, such as passengers, were limited to R25 000. The new amendment act has now brought about a fairer dispensation to all road users. If you were injured in a car accident and want to lay a claim against the Road Accident Fund you can do so in your own capacity but we would rather recommend that you contact a lawyer to do it on your behalf. It can become a very long and cumbersome procedure to handle on your own.

HEALTH WARNING Supermarket Shelf Poisons anybody that takes Vitamin C (and most people should) should avoid the following Soft drinks: Sunkist, Fanta, Diet Coke, Sprite, & Pepsi Max.
These drinks contain Sodium Benzoate, 211 on the label. A chemical reaction between Vitamin C and Sodium Benzoate creates Benzine a highly carcinogenic chemical (story by Channel 9). Benzine has the ability to severely damage the DNA in the Mitochondria to the point that it totally inactivates it, knocks it out altogether. The Mitochondria consumes Oxygen to give you energy, and if you damage it, then the cell starts to malfunction very seriously, often fatally. A whole array of Diseases has been tied to the damage to the DNA, including Parkinson's Disease and quite a lot of Neuro-Degenerative Diseases. This is a follow-up of all the TV station's stories on Mentos and Diet Coke. Don't mix these two either; they cause a chemical reaction (explosion) in the stomach. It's not only Mentos but also any Mint products: Mint Life Savers, Tic Tac's, Cool Mint's, etc. The Mint is not the culprit here but the Aspartame in the Diet Drinks, 951 on the label. Also avoid 950 Acelsultame F (same thing). Aspartame poisoning has been scientifically linked to 92 Symptoms of Disease ... Still going to drink your Diet Drinks??? Most European countries have forbidden the importation and use in their Country of Aspartame including all makes of Saccharin, example Equal, Nutra-Sweet, Spoonful & all diet drinks, including 6,000 consumer good's and beverages sold on supermarket shelves. This ban affect's all use of this product in any type of consumable and infringement will carry penalties that go from 9,000 Euros to 90,000 Euros. Mexico is also considering banning all 6,000 products of Aspartame on its supermarket shelves. In Mexico Aspartame is known as Rumsfeld's Disease, after George Bush's mate Donald Rumsfeld. The Nutra-Sweet company and Searle are owned by Monsanto who appointed Rumsfeld as their General Manager so they could use his clout with Parliament to get this deadly poison passed by the FDA and boost their sales of Aspartame products. Avoid all toothpastes made in China , especially Colgate's as they contain Ethylene Glycol. This is an anti-freezing agent, highly toxic and even fatal -- it destroys the liver, kidneys, lungs, blood cells, heart and the nervous system. It is also in some mouth washes, make-up, aftershaves, baby powder and wipes, shampoos, and deodorants. Avoid Smarties; they contain almost every toxic artificial colour on the market. The worst are 102 and 104, and the worst of all is 110 (carcinogenic), 124 (undesirable), 127 (carcinogenic), 128 (extreme caution). 129, 131, and 133 are also carcinogenic. To top it off Smarties are not even made of Chocolate - neither are Tim Tam's. Synthetic chocolate has no nutritional food value whatsoever.
